24Fall2014TheMississippiLawyerTortReformTheCosttoJusticeUsingnationallyacceptedstatisticalmeasuresofastatesprogressthereisnoevidencethatthetortreformmeasuresenactedin2002and2004havefueledanysignificanteconomicgrowthnorhavetheyledtohigherqualityhealthcarefortheaverageMississippian.WhatwedoknowisthattortreformhasunderminedtheabilityofaverageMississippianstoobtaincompletejusticeinourcivilcourtsandhasremovedadeterrenttonegligentbehaviorandmal-practiceinourstatesmedicalcommuni-ty.Arecentstudyonthedeterrenteffectsoftortreformlawsfoundevi-dencethatreducedriskofmedmallitiga-tionduetostateadoptionofdamagecapsleadstohigherratesofpreventableadversepatientsafetyeventsinhospi-tals.4Thatrelaxationincareiswide-spread...andapplies....bothinaspectsofcarethatarerelativelylikelytoleadtoamalpracticesuit.5Accordinglythebroadrelaxationofcaresuggeststhatmedmalliabilityprovidesgeneraldeter-renceanincentivetobecarefulingen-eralinadditiontoanyspecificdeter-renceitmayprovideforparticularactions.6Inshortbyenactingso-calledtortreformMississippianshavecompro-misedtheirfundamentalrightsandpossi-blythequalityoftheirhealthcare.BecauseoftortreformMississip-piansareunabletoholdwrongdoersfullyaccountable.Takeforinstancethefami-lyofKathyClemons.BecauseadoctorpanickedandrefusedtreatmentthatisnormallyprescribedMs.Clemonsandherunbornchilddiedenroutetothereceivinghospital.Defendingthesuitthefederalgovernmentdidnotdisputethefactsandthecasetriedsolelyontheissueofdamages.Thefederaljudgereducedhisnon-economicawardforthesufferinganddeathofthemotherandchildfrom5.45milliontothelimitsper-mittedbyMiss.CodeAnn.1-1-60thoughhenotedinhisdecisionAllgriefisnotequal.Allpaincan-notbereducedtoaone-size-fits-allsum.....InMississippithoughonessufferingatthehandsofahealthcareproviderisworthnomorethanahalfamilliondollarsnomatterhowegregiousandnomatterifyoursufferingleadstoyourdeathyourunbornchildsdeathandleavesyourchildrenorphans.Thisisoffensive.7Thecapsonnon-economicdamagesrepresentaone-size-fits-allfixinherentlyatoddswithhowourcivilcourtsystemhasoperatedsincethebeginning.Beforelawyersintroducetheirclientsbeforeanyevidenceispresentedandbeforeanylawiscitedtheverdictiscappedbylaw.Thejurysconstitutionaldutytodeterminedamagesiscurtailed.Unfortunatelythisproblemwillonlygetworse.Capsarenotevenworthtodaywhattheywerewheninitiallyenacted.AccordingtotheU.S.BureauofLaborStatisticsthe500000capinstitutedin2004isworth392672todayandthesecapswillcontinuetolosetheirvalueastheyearspass.Theelderlychildrenstay-at-homemothersaredis-proportionatelyhurtbycaps.Theelderlyandstay-at-homemotherssuffermorebecausetheirdamagesarealltoooftennon-economic.Ourstateschildrensufferdisproportionatelyaswellnotonlybecausetheyhavenoincomelossesbutalsobecausethelifetimeoffuturepainandsufferingfacingapermanentlyinjuredchildsooftenexceedsthecaps.Thissystemofcapsoffendsbecauseitisfaciallybotharbitraryandinequitable.MoreoverIbelievecapsareunconstitutional.WhiletheissuehasnotpresenteditselftotheMississippiSupremeCourtthequestionwillinevitablybeaddressed.TheCourtdeclinedtoaddresstheissuelastyearinSearsvLearmonth95So.2d633Miss.2012.AsofthiswritingtheissuemaybepresentedinthecaseofInterstateRealtyManagementCo.etal.v.Carteretal.2013-CA-00420-SCT.Severalotherstateshavestruckdownlegislativeeffortstorestrictthejudiciary.Fivestateconstitutionshaveprohibitionsontheinstitutionofdamagescaps.8Twomoreconstitutionallyprohibitthecapondamagesinthecaseofwrongfuldeath.9TheSupremeCourtsofeightstatesincludingourneighborsinAlabamaandGeorgiahavedeclareddamagecapsunconstitutional.10Georgiawheretheconstitutionalguaranteeofacitizensrighttoatrialbyjuryiseffectivelyiden-ticaltoourownstruckdowncapsbasedsolelyuponthejuryissue.11Furthermoreourstatebillofrightsprovidesfordueprocessandforaccesstothecourts.12TheByEdwardGibsonPresidentMississippiAssociationofJusticeBaySt.LouisMS
